Software for the T-Kernel 2/x86 Evaluation Kit
End User License Agreement (EULA)
Notice: This Agreement in English is provided for reference
purposes only. The original and effective license agreement is written in
Japanese. Please see the other side of this sheet.
Important: You must read the terms of use below before
breaking the silver seal.
- Before breaking the silver seal on the CD-ROM named T-Kernel 2/x86
Evaluation Kit Software and Related Documents, the User must read the
terms of use given in this End User License Agreement (hereinafter "this
EULA").
- Of the software included in the T-Kernel 2/x86 Evaluation Kit Software
and Related Documents, this EULA shall apply two kinds of software described
below (collectively referred to hereinafter as "the Software").
- (a) Target-side software:run on the PC/AT compatible or VMware.
- Including PMC T-Monitor, PMC T-Kernel, PMC T-Kernel Extension,
device driver software, and PMC T-Shell (GUI middleware and TCP/IP).
- (b) Host-side software run on the host PC for development.
- Including libraries, header files, and development tools such
as T-Kernel support part of GNU C/C++ compiler and source debugger
gdb.
- Use of the Software shall be permitted only on condition that the
User agrees to abide by the Terms of Use below. If you do not agree
to this EULA, contact your seller before breaking the seal on the CD-ROM
disk and hardware packaging.
- By breaking the silver seal on the CD-ROM or hardware packaging,
for any reason, the User is considered to have indicated agreement with
this EULA.
Article 1. Intellectual Property
- The User shall be permitted to use the CD-ROM and hardware containing
the Software, but such use shall not be construed as granting ownership
of the intellectual property in the Software. The intellectual property
in the Software belongs to the developer Personal Media Corporation
(hereinafter "PMC") or to the suppliers of software to PMC.
Article 2. Permitted Uses
- The User shall be granted a non-transferable and non-exclusive right
to use the Target-side software only on the single PC/AT compatible
machine or VMware (hereinafter the "the Target").
- The User shall be granted a non-transferable and non-exclusive right
to use the Host-side software only on the single Windows machine or
Linux machine (hereinafter the "the Host").
Article 3. Prohibited Uses
- The User shall not use the Target-side software on multiple units
of the Target concurrently. In order to use the Software on multiple
units, acquire the necessary number of packages or licenses.
- The User shall not install and use the Host-side software on multiple
units of the Host concurrently. In order to install the Host-side software
on multiple units, acquire the necessary number of packages or licenses.
- The User shall not, without the express written consent of PMC,
duplicate, modify, reverse-engineer or disassemble the Software. This
prohibition does not apply to duplication for backup purposes when the
Software is installed, or to modification of the sample programs provided
with the Software. In such cases the User shall have the same obligation
of copyright display for the duplicated software as for the original
copy.
Article 4. Specification Changes and Maintenance
- PMC may, without prior consent or prior notice to the User, change
the specifications of the Software or cease the manufacture and sale
of the Software.
- If the operation of the Software does not conform to the accompanying
documentation, PMC shall endeavor to make repairs, for at least one
year from the date of purchase, in the case of users who have registered
officially with PMC.
Article 5. Warranty and Limitation of Liability
- PMC warrants that the CD-ROM medium in which the Software is supplied
shall be free of defects for a period of 60 days from the date of purchase.
If a defect is discovered in the CD-ROM medium in which the Software
is supplied, the User may obtain a replacement copy by returning the
defective item to PMC along with proof of purchase.
- PMC makes no warranty as to whether the functions of the Software
meet the User's needs, and does not warrant that the software will operate
without interruption or that the result of its operation will be error-free.
- PMC shall not be liable for any direct or indirect damages arising
from the use of the Software or for payment of compensation, except
as otherwise required in national or local legal statutes.
Article 6. General Provisions
- The provisions in this EULA do not affect or prejudice the statutory
rights of a consumer.
- The provisions in this EULA shall be governed by the laws of Japan.
- If any provision of this EULA shall be held by a court of competent
jurisdiction to be contrary to law, the remaining provisions of this
EULA will remain in full force and effect.
- In disputes between the User and PMC regarding the provisions in
this EULA, the Tokyo District Court in Tokyo, Japan shall have jurisdiction
as the court of first instance.
- The User shall not export, ship or transfer this product to a country
where prohibited by the foreign exchange, customs or other laws of Japan.
